Judge Denies Injunction for State Girls' Hockey Tournmanet

United States District Court Judge Paul A. Magnuson recently ruled in favor of the Minnesota State High School League regarding the venue for the 2004 Minnesota State Girls' Hockey Tournament. Bassford Remele Shareholder Mark R. Whitmore represents the Minnesota State High School League in connection with a lawsuit brought by eleven girl hockey players, alleging that the location of the Girls' State High School Hockey Tournament violates Title IX.
In connection with that lawsuit, the plaintiffs sought an injunction which would require the Minnesota State High School League to move the 2004 Girls' State High School Hockey Tournament from Ridder Arena at the University of Minnesota to the Xcel Energy Center, the site of the Boys' State High School Hockey Tournament.
Mr. Whitmore argued that, “Equality isn't Identicality” such that the law allows the Minnesota State High School League to host state tournaments at comparable, but not identical, arenas. Although the one-year-old Ridder Arena is smaller than the Xcel Energy Center, it is the only arena in the nation built for women's hockey. Ridder Arena is located on the University of Minnesota Campus, hosts the top-ranked Minnesota Golden Gopher Women's Hockey Team and is the host of the Western Collegiate Hockey Association's Final Five Tournament later this year.
After hearing arguments on both sides of the issue, Judge Magnuson denied plaintiffs' motion for a preliminary injunction. As a result, the 2004 Girls' State High School Hockey Tournament will take place at Ridder Arena at the University of Minnesota Campus as had been previously arranged by the Minnesota State High School League.
