The United States Court of Appeals for the Eighth Circuit recently affirmed the district court's dismissal of claims in a civil rights action.
Plaintiff, whose first murder conviction was overturned by the Minnesota Supreme Court because the jury heard a confession that the Court held was obtained in violation of his Fifth Amendment Rights, brought a § 1983 action against the arresting officers for allegedly coercing the confession. While the civil action was pending, plaintiff was again convicted of murder without the confession being admitted. The District Court granted the arresting officers summary judgment dismissing the lawsuit on a number of grounds.
The Eighth Circuit affirmed the summary judgment, ruling that the officers were entitled to qualified immunity and that § 1983 did not provide the plaintiff a remedy for any alleged violation of his Miranda rights.
