Directed Verdict in Medical Malpractice Wrongful Death Case

Bassford Remele Shareholder Mark R. Whitmore recently obtained a directed verdict at the close of the evidence in a trial that occurred in Pierce County, Wisconsin. The lawsuit alleged that hospital nursing staff were negligent in the monitoring of a patient's vital signs and that their negligence caused or contributed to the death of a patient. The patient died of a significant bacterial infection, approximately 12 hours following his arrival at the hospital. After hearing all the evidence from the plaintiff, as well as testimony from hospital nursing staff, medical and nursing experts, the judge granted the hospital's motion for a directed verdict, concluding as a matter of law that there was not a sufficient amount of evidence to allow the jury to consider the allegations of negligence against the hospital. Bassford Remele Associate Paula M. Semrow was closely involved in the trial and played a key role in the successful result.
