Minnesota Supreme Court to Address Minnesota Child Abuse Reporting Act

Bassford Remele Shareholder Mark R. Whitmore has been retained to file an amicus brief to the Minnesota Supreme Court in a matter entitled Becker v. Mayo Foundation. The critical issue on appeal is whether the Minnesota Child Abuse Reporting Act imposes civil liability on a physician, hospital, or other care giver for failing to report a matter to Child Protection when the statute is silent on the issue of civil liability and specifically imposes criminal, licensing and other penalties upon those professionals for failing to report. Along with Mr. Whitmore, Bassford Remele Shareholders Charles E. Lundberg and Susan E. Gustad will prepare the amicus brief on behalf of the Minnesota Hospital Association, the Minnesota Medical Association, the American Medical Association, the Minnesota Orthopaedic Society, the American Association of Orthopaedic Surgeons, the American College of Emergency Physicians, and the American Academy of Pediatrics, Minnesota Chapter.
Mr. Whitmore has successfully tried cases in federal and state courts throughout the upper midwest involving a wide range of areas including medical malpractice, commercial and employment disputes, and personal injury. Although he handles a wide range of matters, much of his practice focuses on defending medical malpractice claims and providing guidance to area hospitals on risk management, claim prevention and governmental investigations. This practice extends to the representation of doctors, nurses and other professionals in matters pending before the Minnesota licensing boards.
Mr. Lundberg has handled hundreds of appeals and is recognized as one of the state's top appellate attorneys. He was recently inducted as a Fellow in the American Academy of Appellate Lawyers. In addition to more than 25 years of experience in appellate law, Mr. Lundberg is a “lawyer’s lawyer,” advising attorneys and law firms on matters involving legal malpractice, legal ethics and other aspects of the law of lawyering. He served for twelve years on the Minnesota Lawyers Professional Responsibility Board, the last six of those years as Board Chair.
Ms. Gustad regularly represents hospitals and health care providers in medical malpractice cases as well as other professionals in professional liability claims. She also represents municipalities in civil rights and property damages cases, and handles complex insurance coverage matters as well as commercial litigation. Ms. Gustad is a member of the Health Law Section of the Minnesota State Bar Association. She is an annual speaker at the medical malpractice seminar presented jointly by the Minnesota Defense Lawyers Association and the Minnesota Trial Lawyers Association.
