U.S. District Court Issues Directed Verdict

Bassford Remele Shareholders Edward F. Fox and J. Aron Allen successfully represented a major U.S. medical device manufacturer in a multi-million dollar products liability action venued in the United States District Court in the Eastern District of Louisiana.
Plaintiff alleged that she was seriously and permanently injured by the malfunction of a PMA approved interventional cardiovascular medical device and was seeking damages of approximately $6 million. Most of the strict liability claims were dismissed on summary judgment based on pre-emption, and the matter proceeded to trial on a manufacturing defect claim. The case involved a host of technical medical, manufacturing and FDA regulatory issues that involved testimony from multiple experts, including plaintiff's treating physicians.
At the conclusion of plaintiff's case, the Court directed a verdict in favor of the medical device manufacturer. This matter is currently on appeal to the Fifth U.S. Circuit Court of Appeals.
