In 2000, plaintiff was driving his vehicle on I-94 in Otter Tail County, Minnesota, with his ex-wife and two daughters as passengers. The car was traveling in the left lane when it was struck from the behind and crushed by a tractor-trailer driven by defendant. One of plaintiff's daughters was killed in the crash, and the remaining occupants were injured.
Plaintiff blamed the inattention of the trucker for the accident, and claimed that the truck's speed was unsafe for the wet, snowy conditions. The truck was found by state investigators to have traveled 1900 feet after the impact before stopping, and the driver testified that he did not apply his brakes until he was 10 feet behind plaintiff's car.
The wrongful death claim and the claim asserted by the surviving passengers were settled the first day of trial. The defendant contested liability, arguing that plaintiff failed to comply with restrictions on his driver's license related to a pre-existing disability, that he lost control of his vehicle just prior to the crash, and that the accident was unavoidable.
The jury found the defendant 95% negligent and awarded Bassford Remele's client (the driver) in excess of $4.7 million for past and future medical expenses, and past and future pain and suffering.
