Mark Whitmore Obtains Defense Verdict in Medical Malpractice Case

Bassford Remele Shareholders Mark R. Whitmore and Charles E. Lundberg recently filed an Amicus Curiae brief on behalf of the Minnesota Hospital Association, the Minnesota Medical Association and the American Medical Association in the case of Larson v. Wasemiller, et. al., currently pending before the Minnesota Court of Appeals. The case is extremely significant because the Court of Appeals has been asked to adopt negligent credentialing (or negligent privileging) as a viable cause of action against hospitals, a claim that has never before been recognized by Minnesota's Appellate Courts. The amicus brief argues that recognizing such a cause of action would have an adverse impact on hospital peer review and would drastically alter medical malpractice litigation in the State of Minnesota.
