The case is extremely significant because the Court of Appeals has been asked to adopt negligent credentialing (or negligent privileging) as a viable cause of action against hospitals, a claim that has never before been recognized by Minnesota's Appellate Courts. The amicus brief argues that recognizing such a cause of action would have an adverse impact on hospital peer review and would drastically alter medical malpractice litigation in the State of Minnesota.
