Representative/Published Case: National Hydro Systems, a Div. of McNish Corp. v. M.A. Mortenson Co., 507 N.W.2d 27 (Minn. App. 1993). Subcontractor on wastewater treatment plant expansion project sued engineer for compensation costs allegedly arising from negligently prepared equipment specifications. The District Court entered summary judgment for the engineer, finding that circuitry of subcontractor's indemnification obligations rendered subcontractor's claim against engineer pointless. Subcontractor appealed. The Court of Appeals held that indemnity provision in contract governing project did not require contractor to indemnify engineer for claim against engineer based on engineer's own negligence. The Supreme Court reversed and remanded.
