Jessica Kometz to Present on Differing Perspectives Relating to Capacity and Undue Influence

Bassford Remele Attorney Jessica Kometz will present on the panel “Perspectives on Those Notorious Red Flags - A Dialogue Between Estate Planners and Estate Litigators" for the Minnesota State Bar Association Probate, Trusts and Estates Section on Thursday, February 23, 2023.

  • Issues regarding capacity and undue influence are well-known to both estate planners and estate litigators. That said, the perspective can be very different if you are a planner who is working with a client on their estate plan versus a litigator who examines a fact pattern after the planning has been done. This seminar will be a frank discussion between practitioners across the spectrum with the goal of informing everyone’s practice for the better.

Jessica Kometz maintains a practice with a focus on assisting families, businesses, and individuals in maneuvering through trust and estate conflicts, as well as in the areas of employment law and commercial litigation. In her trusts and estates practice, Jessica works with trust beneficiaries, trustees, and other fiduciaries in resolving will and trust conflicts and petitions for guardianship and/or conservatorship. In her employment practice, Jessica advises and represents clients in a wide spectrum of concerns, such as navigating reasonable accommodation requests, terminating employees, etc. and has successfully defended harassment and discrimination claims in court and with various administrative agencies. Jessica also has experience conducting investigations for employers, school districts, and colleges relating to Title IX and sexual misconduct issues, discrimination, and harassment.
