Class Action/Multidistrict Litigation

Class action lawsuits and multi-district litigation involve many players, which makes for especially complex trial procedures and logistics. Managing all of it requires deep knowledge — a knowledge we have built over the years handling cases in Minnesota and across the country. We have extensive experience in every aspect of these matters — from the detailed investigation process, to the ins and outs of trial and appeal, to the creative approach sometimes needed to reach a resolution that meets parties’ expectations.

Whether we are serving as lead counsel or coordinating the work nationally, we have been involved in cases of all shapes and sizes. Our recent wins include a dispute between NHL players and the league over concussion liability, a class action suit against a national insurer facing hundreds of thousands of claims, and a federal case against a collection agency charged with alleged violations of the Fair Debt Collection Practices Act.

Representative Cases

Currently serving as local counsel in a pending class action involving the Telephone Consumer Protection Act.

Served as co-lead counsel in a consolidated proceeding of more than 70,000 plaintiffs seeking damages arising from a multinational biotechnology conglomerate’s alleged premature commercialization of genetically modified corn products, resulting in a favorable settlement. In re: Syngenta Litig., No. 27-CV-15-3785 (Hennepin Cty. Minn. 2017).

Currently serving as liaison counsel to a proposed class in a multi-district class action involving the National Hockey League, obtaining a ruling denying a motion to dismiss.

Represented a collection agency on appeal, obtaining a decision reversing a federal district court order granting class certification on claims involving the Fair Debt Collection Practices Act. Powers, 776 F.3d 567 (8th Cir. 2015).

Represented a group of distributors, obtaining dismissal of an antitrust class action. Insulate SB, Inc., 797 F.3d 538 (8th Cir. 2015).

Defended a national credit insurer, favorably resolving a nationwide class action involving hundreds of thousands of claims.

Served as national coordinating counsel for a global pharmaceutical company in litigation concerning allegations arising from the use of hormone replacement therapy.
