Bassford’s Consumer Finance Group

Our Consumer Finance practice group works with lenders of all shapes and sizes (from credit unions to online lenders to alternative financers), debt purchasers, fintechs, background screeners, law firms, collection agencies, healthcare revenue cycle management companies, and repossession agents to provide holistic legal services.

What does that mean, exactly? Simply put, we strive to provide one-stop-shop representation on a national scale to all who inhabit the consumer financial ecosystem (except consumers and borrowers—we don’t do that work). Specifically:

  • Every day we serve as a compliance resource to our clients, including outside general counsel engagements. We formulate effective risk management strategies to avoid litigation and unwanted regulatory scrutiny (and to fix “problems” before they get worse).
  • When litigation is unavoidable (and, spoiler alert, it often is in these highly-regulated industries), we represent our clients’ interests in state and federal district courts across the country, as well as the bankruptcy courts, courts of appeal, and various arbitration forums. We’re not just “paper warriors,” either—we try cases to juries and are very comfortable in the courtroom.
  • We also help our clients grow and protect their revenue. From basic contract review and negotiations to complex loan documentation, general corporate structure, client relations and disputes, investor growth strategy, buy-sell agreements, mergers, acquisitions, intellectual property, and real estate projects, issues, and engagements, we have the transactional angle covered.

Bassford’s Bankruptcy and Creditors’ Remedies Group

Our Bankruptcy and Creditors’ Remedies team helps our creditor clients get their money and collateral back—simple as that.

Our Team regularly leverages its knowledge of and experience with the Bankruptcy Code, Uniform Commercial Code, Uniform Fraudulent Transfer Act, and various state judgment enforcement statutes to obtain superior results for our client base.

Some more particulars:

  • Insolvency proceedings—from the basic (e.g., lift stay motions, objections to plan confirmation) to the complex (e.g., unsecured creditor committee counsel, objections to discharge);
  • Commercial collection and judgment enforcement;
  • Replevins;
  • Loan workouts;
  • Foreclosures and evictions;
  • Receivership and assignment for benefit of creditors actions;
  • Mechanic’s liens; and
  • Personal guaranty litigation.

Role Description

This is a full-time hybrid role, located in Minneapolis, MN, with flexibility for some remote work (or, potentially, for the right candidate, fully remote if based outside of Minnesota).

As a member of Bassford’s Consumer Finance and Bankruptcy and Creditors’ Remedies Teams, you will work closely with shareholders representing a broad range of financial institutions in compliance, litigation, and transactional matters throughout the United States. There will be a heavy emphasis on written work product and the ability to interface effectively and directly with firm clients.

Our firm believes in putting our people into active litigation participation as soon as they’re ready—from depositions, to motion practice, to trial. You will not “wait in the wings” for ten years—as soon as you establish trust, commitment, and competence, we’re putting you in the game. If you want to become a well-rounded litigator and trial attorney in the consumer financial sector, this is the place to do it.

Qualifications

  • Attitude above all else—willingness to jump in with both feet, to be coachable, and to work well with others as part of a team. There are no sharp elbows here.
  • Ability to think independently and exercise sound judgment
  • Strong command of the written word
  • Ability to synthesize complex legal and regulatory concepts into easily understood and digestible terms, for communication to courts, clients, and juries.
  • Proficiency in conducting thorough legal research
  • Self-motivated and detail-oriented
  • Adaptability and ability to manage multiple cases simultaneously
  • Juris Doctor (J.D.) degree from an accredited law school
