Bassford Remele Obtains Successful Ruling Addressing Coverage for COVID-19 Business Interruption Claims

Bassford Remele obtained what is believed to be the first Minnesota state court ruling addressing insurance coverage for COVID-19 business interruption claims. The court concluded that losses stemming from the Governor’s Emergency Orders limiting restaurant operations to delivery and carry-out service only, and later restricting capacity, were not caused by “direct physical loss of or damage to” covered property and fell within various policy exclusions.
