Talkin' Experts: The Implications of Rygwall

The Minnesota Supreme Court in Rygwall reaffirmed the causation standard in medical negligence lawsuits - a plaintiff must show by qualified expert testimony that it is “more likely than not that the defendant’s conduct was a substantial factor in bringing about the result”. More specifically, the Rygwall court requires that a qualified expert, whose opinion relies on proper foundation, must adequately explain the “how” and “why” the medical provider’s alleged negligence caused the plaintiff’s claimed injury, such that a court is satisfied that a jury will be able to decide liability without engaging in speculation or conjecture.

Minnesota’s regulatory landscape is rapidly reshaping how healthcare providers approach billing and collections. Recent legislation—including the Financial Screening Law and the Debt Fairness Act—introduced significant changes that directly impacted hospital and clinic operations. These laws now require providers to screen all patients for insurance and charity care eligibility, broadened the definition of “collecting party” to include providers themselves, eliminated spousal liability, and prohibits care denial or suspension based on unpaid medical debt. This session will provide a practical overview of these legal changes, their operational implications, compliance challenges, and what providers should anticipate going forward.

Attorneys who work in or behalf of health organizations work with individuals who have experienced trauma including as a result of sentinel events. This session will explore how the work we do and the exposures we have may cause vicarious trauma. We will explore how lawyers working in healthcare can recognize the symptoms of trauma in ourselves and others and how effective mental health strategies and policy implementation can lead to healthier organizations.
